    As much as American society glorifies them, you must remember that doctors are still human, and as being such are prone to make mistakes.  Punishing a doctor for being human would not be very reasonable, but at the same time it should not be an excuse for doctors who behave negligibly.  Obviously, this is a very tight rope to walk, and the United States legal system has a system that they use in order to determine if a case is a viable medical malpractice case or not.  Basically, the plaintiff, or the individual filling the suit, and his/her attorney will have to prove that the defendant, or the one the suit is filed against, acted negligibly when dealing with the plaintiff (or the individual(s) the plaintiff is filing suit on the behalf of) which caused undue harm or damage to the plaintiff (or the individual(s) the plaintiff is representing).  Negligence is proven through showing “causation” or that the defendant’s actions directly caused the unreasonable harm or damage to the plaintiff.  In cases of medical malpractice, the general medical protocols that are normally used are looked upon to decide the standard of care that a normal physician should and would take.  So, when proving cases of medical malpractice, the plaintiff’s attorney must show that the defending physician did not exercise the normal or “due” standard of care when dealing with the plaintiff’s or patient’s ailment.
